What you need to know about part-time contracts

A 4-hour-a-day contract may be right for you if you have children and need a career with fewer hours, or if you are a college student or retired and looking for extra income.

Thinking of working part-time? Here are the most important aspects of this type of contract.

1. The average number of weekly or monthly working hours of a part-time employee is less than that of a full-time employee.

2. Part-time employment contracts will include the following information once they have been negotiated and concluded:

a) Specify the number of hours to be worked;

A part-time employment contract can be concluded for any number of hours, but this must be discussed by mutual agreement, either in terms of hours per day, hours per week or hours per month, but this must be explicitly stated when the contract is signed in writing and subject to prior information or negotiation.

b) How these hours will be distributed;

Part-time work involves working the agreed number of hours per day, week or month and how the hours are allocated.

c) Under what conditions can the hours be changed;

As overtime is prohibited and exceeding daily, weekly or monthly hours is interpreted as undeclared work in such contracts, particular care must be taken in the preparation of working time.

d) Working overtime is prohibited.

For each employee who works outside the working hours established in the individual part-time employment contract, a fine of 10,000 lei is imposed, not exceeding 200,000 lei cumulatively.

* In addition to these, part-time employment contracts will also include mandatory elements for full-time employees. In the absence of these elements, a part-time employment contract will be treated as a full-time employment contract.

3. Employees working part-time shall enjoy the same rights as full-time employees, as provided for by applicable legislation or collective agreements, and their pay entitlements shall be based on the duration of their work in accordance with the standard working hours.

4. Part-time employment contracts may be of indefinite or fixed duration, as long as the necessary conditions are met, and written form is compulsory for each contract. In addition, all aspects of part-time and/or fixed-term employment must be provided to ReviSal.

5. Currently, part-time employees are not obliged to pay at the level of the guaranteed minimum wage as part of the contribution and taxation of earned income and will be taxed at the level set by the individual part-time employment contract.

Calculation of a part-time employee's salary

In terms of income, part-time employees are paid in proportion to the time they work, compared to the salary of a full-time employee.

The law stipulates that for a part-time employment contract of 4 hours a day, the gross salary cannot be less than 1,150 lei and for a part-time employment contract of 2 hours a day, it cannot be less than 575 lei.
